AGENDA ITEM <br />Presenter: <br />1. Purpose. This application is regarding an after-the-fact variance to pennit a detached shed <br />constructed less than 10 feet from the principal structure. <br />2 . MN§lS.99 Application Deadline. The application was received on September 20 , 2017; it was <br />considered as complete on November 151• Therefore the 60-Day review period expires on <br />December 3P', 2017 . <br />3. Background . A pennit for the new home under construction on the property was issued in May, <br />2017. However, due to the remoteness of the Big Island property and winter weather <br />approaching, the applicant began construction on the 300 square foot shed prior to the issuance of <br />a building pennit this fall. The location of the shed is 6 . 7 feet from the principal structure where a <br />10-foot setback is required . Construction on the shed has been stopped. <br />4. Planning Commission Comment. On November 20111 , the Planning Commission held a public <br />hearing and reviewed the application. Following the public hearing the Commission voted 5 to 0 <br />on a motion to approve the after-the-fact variance subject to issuance of a building permit <br />conditioned on compliance with Building and Fire Codes . The Commission noted that the 10 foot <br />setback require ment is mainly to address concerns with massing , and massing is not a concern due <br />to the island location of the lot, and the setback from the lake. <br />5. Public Comment. No comments from the public were received regarding this application. <br />6 . Staff Recommendation .
