Hardcover improvements shall be limited to the improvements as shown on the site plan included as Exhibit A of this resolution,with the exception that the house shall be located at a setback of 50' from the OHWL. Hardcover in the 0-75' setback area is approved at 772 s.f. or 20.4%, in the 75-250' setback area at 2,410 s.f. or 27.2% and 250-500' setback area at 202 s.f. or 12.1%. Any further hardcover on the property will not be looked at favorably. Any amendments to the site plan may require further Planning Commission and City Council review. 2. All hardcover improvements scheduled for removal shall be completed prior to the footing inspection for the new construction. Applicants' contractor shall obtain the required demolition permits for the removal of the principal structure. 3. Authorities granted by this variance run with the property not with the applicants,but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (June 12, 2001). 4. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property.
