Box 188 <br />Excelsior, MN -55331 <br />TYPE OF APPLICATION: Vacation, Variance & Conditional Use Permit <br />DATE OF MEETING: July 15, 1991 <br />NOTES AND SPECIAL CONDITIONS <br />VOTE: 7 For O Against <br />The Planning Commission recommended the following concerning the above <br />referenced applications: <br />A. Application #1606 was approved as presented, subject to the conditions <br />set forth in the staff memo dated July 5, 1991. The Planning <br />Commission added the following: <br />1. Annual Joint Use Dock License to be limited to 15 slips. <br />2. Fire rings shall be subject to special protection such as those <br />established for Big Island Vets Camp (supply of sand, water, <br />blanket, etc.). <br />3. Applicant shall be responsible for submitting all proposed <br />changes in by-laws related to membership to City for review. <br />B. Application #1659 -Vacation of _20' unimproved alley. The Planning <br />Commission recommended unanimous approval based on the following <br />findings: <br />1. The City found no public use or interest in the unimproved 20' <br />right-of-way. <br />2. The DNR concurred with vacation request finding no interest in <br />the part of the DNR/State in maintaining the 20' wide public <br />access to lake. <br />3. Based on the pattern of owners.hip of the properties of the <br />abutting properties, the unimproved right-of-way no longer serves <br />as access. <br />Approval of the vacation is subject to applicant executing a special <br />lot combination as already discussed above. <br />c. Application #1660 -Variances. The Planning Commission unanimousoly <br />approved variances as proposed that would allow repairs to existing <br />swimming dock/deck located within the lakeshore protected area subject <br />to the hardships noted in staff memo of July 8, 1991 as set forth by <br />applicant in applicant's addendum.
