CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 5 3 4 :l <br />c. The approximately 600 s.f. building is necessary to adequately serve <br />the number of users and regular level of use of the Power Squadron <br />activities. <br />4. The City Council has considered this application including the findings <br />and recommendation of the Pla1ming Commission, reports by City staff, <br />comments by the applicant and the public, and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a conditional use pennit for a new toilet and shower facility to be constructed for <br />the Minnetonka Power Squadron, a day recreation area use allowed conditionally within <br />the RS Seasonal Recreational Zoning District, subject to the following conditions: <br />1. Council approval is based on the site plan submitted by the applicant and <br />aimotated by City staff, attached to this Resolution as Exhibits A and B. Any <br />amendments to the site plan which are not in confonnity with City codes will <br />require further Planning Conunission and City Council review. <br />2. Removal of the existing toilet building is required and its removal shall be <br />completed upon commencement of the use of the new toilet building. The <br />existing non-compliant septic system shall be abandoned according to City Code. <br />3. Authorities granted by this resolution run with the property not with the applicant, <br />but are permissive only and must be exercised by obtaining a building permit for <br />the new construction within one year of the date of Council approval, or the <br />conditional use pem1it amendment will expire on that date (July 11, 2006). <br />4. Violation of or non-compliance with any of the tem1s and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />5. The undersigned applicant has read, understood and hereby agrees to the tenns of <br />this resolution and on behalf of the applicant and the applicant's heirs, successors <br />and assigns, hereby agrees to the recording of this resolution in the chain of title <br />of the property. <br />Page 2 of 4
