Zoning Memo #792 <br />April 12, 1994 <br />Page 2 <br />The new RS Ordinance established each individual existing lot or group of commonly owned lots <br />as "record lots 11 <br />• <br />11 Conforming record lots II were those of 5. 0 acres or larger. 11 Substandard <br />buildable record lots" were those less than 5 acres with or without an existing seasonal dwelling <br />structure regardless of lot size, with those vacant lots of 1/3 acre or less being considered as <br />substandard unbuildable record lots. <br />The RS Zoning Ordinance established permitted, conditional and accessory uses, set minimum <br />standards for septic systems, and set minimum standards for building construction and fire <br />protection systems. <br />It was the City Council's intent in 1983 to recognize all existing uses on Big Island, and issue <br />lot area variances and CUPs for existing principal dwellings, guest cabins, day use recreation <br />areas, and overnight camps. City Planner Al Olson created special application forms for the <br />principal dwelling use and guest cabin CUPs, of which there were a significant number, but <br />made no special application for day use recreation areas or overnight camps, of which there <br />were one of each. Rather, he wrote a letter to the Power Squadron requesting specific <br />information in order to draft a CUP resolution acknowledging their existing uses. He assigned <br />a file number to the Power Squadron application but never drafted the CUP, and, once he left <br />the City, Application #792 was lost in the shuffle. <br />It is staff's intent to complete the CUP review process and issue the CUP per the City's 1983 <br />intent. <br />Day Use Recreation Area CUP Requirements <br />Exhibit J contains the requirements of Section 10.31, Subd. 3(C), the standards for a Day Use <br />Recreation Area conditional use permit. Further, that exhibit indicates how the Power Squadron <br />meets each of the requirements: <br />• Exceeds minimum 5 acre lot size requirement. <br />• Dry buildable area of 7 .5 acres (gross area is 9 acres) would allow up to 150 <br />users at one time per code (see discussion below). <br />• Lot width of 1,200' greatly exceeds 200' minimum. <br />• Annual joint use dock licenses obtained yearly since 1969. <br />• Historically licensed by City for 45 transient slips, equal to 1 per 50' of <br />shoreline. <br />• Maintains an established swimming area separate from boating areas. <br />• Maintains a vault toilet system which is pumped out as needed. <br />• No recent building permits have been requested. <br />• A telephone is available at the site as required. <br />• Property does abut the lake as required. <br />• Property exists in a single tax parcel as required.
