This application was reviewed as Zoning File #2590. <br /> 2. This property is located in the LR-1C Zoning District,where .5 acre or 21,780 s.f. is <br /> the minimum lot area. The property consists of approximately .114 acres or 4,956 <br /> s.f. <br /> 3. The Orono Planning Commission reviewed this application on June 19, 2000 and <br /> recommended approval by a vote of 4 to 0. <br /> 4. The Planning Commission made the following findings of fact: <br /> A. The structural coverage on the lot is not increasing. <br /> B. The 0-75'hardcover on the lot is decreasing to 1,512 s.f. (55.0%)from 1,592 <br /> s.f. (57.9%). <br /> C. The 75-250'hardcover on the lot is decreasing to 643 s.f. (64.95%)from 707 <br /> s.f. (71.4%). <br /> D. The existing deck is located partially within the right-of-way of Dakota Rail <br /> property. <br /> E. The Planning Commission finds that it is beyond the scope of the City's <br /> authority to grant a variance to replace the deck in its current location because <br /> part of it encroaches into the Dakota Rail right-of-way. <br /> D. The lot is extremely undersized for LR-1C. <br /> 5. The City Council finds that the conditions existing on this property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variances would not adversely affect traffic conditions, light, air, nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br /> or difficulty; is necessary to preserve a substantial property right of the applicants; <br /> Page 2 of 6 <br />
