McCloud <br />Attorney at Law <br />533 West Parkdale Plaza <br />1660 South Highway 100 <br />Minneapolis, MN 55415 <br />March 27, 1985 <br />Re: Big Island Property (Record Lot #22) <br />Dear Mr. Mccloud: <br />This letter is to update you on the action taken by the <br />Planning Commission and City Counci 1 regarding the subdivision <br />for tax purposes of the lakeshore strip of property currently <br />under P.I.D. No. 22-117-23 41 0001 and which was torrensed as two <br />separate parcels some years ago. <br />The Plannin9 Commission first reviewed the application on <br />February 19, 1985. The staff recommendation to the Commission <br />was approval of the subdivision subject to combination of the <br />appropriate parcels per the record lot designations described in <br />the zoning code. Mr. Smedberg, who was present, objected to the <br />combination requirement. The Planning Commission tabled the item <br />pending further discussions between staff and the affected pio- <br />perty owners. <br />In the ensuing discussions, Smedberg gave the impression he <br />was mainly concerned with his buildability rights if the property <br />he is buying was one record lot instead of two, and he would <br />prefer that Lot C, to the rear, be a separate record lot. He was <br />informed that under the zoning code if he owns the contiguous <br />properties, they would be considered in total as one record lot, <br />hence his rights are not negotiable and are spelled out clearly <br />in the code. · <br />In order to facilitate your anticipated closing, this item <br />was again brought to the Planning Commission on March 18, with an <br />outline of the code regulations on Record Lots on Big Island .. <br />Planning Commission voted 6-0 to recommend approval of the <br />division subject to combination of the northerly strip with your <br />Lots 9-10-11 and the southerly strip with Smedbergs Lots 6-7-8. <br />It is a standard policy of the Planning Commission and Council <br />when creating small unbuildable parcels as part of a metes-and- <br />bounds division, to require the resulting parcels to be combined <br />with the appropriate adjacent parcels. <br />BUILDING & ZONING -473-7357 <br />ASSESSING <br />• ADMINISTRATION & FINANCE -473 -7358 • PUBLIC WORKS -473-7359
