SUBDIVISION 8 <br /> FILE NO. 2643 <br /> WI�REAS,Patrick M.Burton and Kirsten M.Burton,(hereinafter"the applicants") <br /> are the owners of the property located at 2601 Rainey Road within the City of Orono (hereinafter, <br /> "the City") and legally described as follows: <br /> Lot 3, Block 1, TREES TO BE and Outlot B TREES TO BE, CITY OF ORONO, <br /> � Hennepin County,Minnesota(hereinafter "the properry"); and <br /> WHEREAS, the applicants have applied to the Ciiy for a variance to Municipal <br /> Zoning Code Section 10.55, Subdivision 8 to permit the construction of a private driveway through <br /> a wetland where no fill is normally allowed. <br /> • WHEREAS, after due published notice and mailed notice in accordance with <br /> vlinnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on November 20,2000,at which time all persons desiring to be <br /> heard coiicerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RI{:SOLVED by the City Council of Orono, " <br /> �Iinnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#2643. <br /> � 2. The property is located in the RR-1B Zoning District,where 2 acres or 87,120 s.f. is <br /> � the minimum required lot area. The property consists of approximately 13.86 acres. <br /> 3. The Orono Planning Commission reviewed this application on November 20,2000 <br /> and recommended approval by a vote of 6 to 0. <br /> 4.
