Tharkelson and Peter A. Thorkelson (hereinafter "the <br /> applicants") are owners of the property located at 440 Big Island within the City of Orono <br /> (hereinafter "the City") and legally described as follows: <br /> Lot 1, Scri��er's Subdivision of Lot E Morse Island Park and Lot 6 and the <br /> South Half of Lot 7, Morse Island Park Second Addition, Hennepin County, <br /> Minnesota (hereinafter "the property"); and _ ;-� <br /> �—� � 1.7, .. ;- 3` ,. ,; �i <br /> WHEREAS, the applicants have applied to the City for an after-the-fact variance <br /> to �lunicipal Zoning Code Section 10.31 Subdivision 8 (C) to permit an accessory structure to <br /> be located 23' from the platted street right-of-�vay where 30' is required. <br /> NO��', THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Nlinnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File #2627. <br /> 2. The property is located in the RS Recreational Seasonal Zoning District requiring <br /> five acres in area. The property consists of 48,781 s.f. or 1.12 acres. <br /> 3. The applicants' son constructed a 12` x �4` accessory buiidin� an inC pr�pe�y <br /> without obtaining the appropriate building permit and in a location not meeting <br /> the required street setback. <br /> 4. The Orono Planning Commission reviewed this application on October 16, 2000 <br /> and voted 3 to 3 on a motion to recommend denial of the request.
