� <br /> � O� <br /> • O O , <br /> ��b. - CITY of ORONO <br /> � � <br /> '� RESOLUTION OF THE CITY COUNCIL <br /> ��`qlfE p4L�'G NO. � J � � <br /> �SH <br /> CONCLUSIONS, ORDER,AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Municipal Zoning Code Section 10.27, Subdivision 5 (B)to allow a front yard setback <br /> of 42' where 100' is required and a side yard setback of 24.2' where 50' is required to permit an <br /> addition to the existing residence. Approval is subject to the following conditions: <br /> 1. Council approval is based on the site plan submitted by the applicant attached to this <br /> resolution as Exhibit A. Any amendments to the site plan may require further <br /> Planning Commission and City Council review. <br /> 2. Applicant is advised that if this project ultimately results in substantial removal of ' <br /> � the existing residence due to unforeseen circumstances,the City Council shall have <br /> the right to reconsider this approval to determine whether the conditions of this <br /> resolution remain applicable. <br /> � 3. Authorities granted by this variance run with the properly not with the applicant, <br /> but are permissive only and must be exercised by application for a building permit <br /> within one year of the date of Council approval,or these variances will expire on that <br /> date (July 24, 2001). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this <br /> �ariance shall constitute a violation of the zoning code,shall automatically terminate <br /> any authority granted herein, and shall be punishable as a misdemeanor. <br /> 5. The undersigned applicant has read, understood and hereby agrees to the terms of <br /> this resolution and on behalf of himself, his heirs, his successors and assigns, <br /> hereby agrees to the recording of this resolution in the Chain of Title of the property. <br /> Adopted by the City Council of the City or Orono,Minnesota at a regular meeting held on the 24th <br /> day of July, 2000. <br /> • Page 3 of 6 <br />
