.� City of ORONO <br />r <br />RESOLUTION OF THE CITY COUNCIL <br />NO.— - <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTIONS 10.22, SUBDIVISION 1 & 2 AND <br />10.55, SUBDIVISION 8 <br />FILE #1060 <br />WHEREAS, J. F. Fleischhacker (hereinafter "the applicant") <br />is the owner of the property located at 2775 Shadywood Roa,9 within the <br />City of Orono (hereinafter "City") and 'Legally described -.is follows: <br />Tracts E and F and Tract G etcept the Northeasterly 7 feet <br />thereof, Registered Land Survey No. 358, Files of Registrar of <br />Titles, Hennepin County, Minnesota (hereinafter "the property"); <br />and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivision 1 and 2 <br />and Section 10.55, Subdivision 8 to permit the construction of a deck <br />and stairway within the 0-75' lakeshore yard, constituting structure <br />and 2.4% hardcover in the 0-75' lakeshore yard where no structure and <br />hardcover is normally allowed, and constituting 38.2% hardcover in the <br />75-250' lakeshore setback zone, in excess of the 25% hardcover <br />normally allowed in the 75-250' lakeshore setback zone. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1060. <br />2. The property is located in the LR-1B Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />August 18 and October 20, 1986, and recommended approval 'of the <br />proposed variance based upon the following findings: <br />A) The applicant revised his original proposal downward to <br />reduce the proposed degree of encroachment into the 0-75' <br />setback zone from 20' to 9.5', eliminating the need for an <br />average setback variance, requiring only a 0.1% increase in <br />75-250' hardco-er, and scaling down from originally proposed <br />3.7% hardcover to 2.4% hardcover in 'ne 0-75' setback zone. <br />Page 1 of 4 <br />
