Dougan, 2785 White Oak Circle - Conditional Use Permit - Resolution List of Exhibits - A - Memo and Exhibts of 10/17/86 B - Planning Commission Minutes 10/20/86 C - resolution This is a request to excavate a si�orage pond and swale for flood control purposes. Please review the memo and exhibits of 10/17/86. The Planning Commission at their 10/29/86 meeting voted 4-0 to recommend approval subject to applicant granting a conservation and flowage easement over the pond area, and subject to a developers agreement since this is a sensitive area in the watershed and might have some impact upstream if work is not completed correctly. Councilmember Callahan, present at the Planning Commission meeting, requested that staff investigate the work which was previously done upstream to determine what effect that might have had on the current runoff situation. Staff would note the following: 1. There is a culvert under White Oak Circle just east of the intersection with Old Crystal Bay Road. This culvert drains approximately 1 acre of the property at 2790 White Oak Circle. This would appear to be an insignificant add4tion to the overall flow through Dougan's property, and will not be affected by Dougan's project. 2. On the west side of Old Crystal Bay Road, some grading work was done a few years ago on the Lawton property at 425 Old Crystal Bay Road. Although no permit was ever issued by the Building & Zoning Department for this work, Public Works Coordinator John Gerhardson notes that this work was done by the property owner to clear the existing drainageway which had gradually filled in behind the driveway culvert over the years, cap :zi-ig cui rt freeze up and and ponding problems on the Lawton property. According to John, there was no significant change in grades at this location. Our airphoto base maps, taken in about 1970 (prior to the creation of White Oak Circle), do show mowed lawn area on either side of the Lawton driveway, which apparently gradually became too wet to mow as the culvert filled in until the property owners re -cleared the drainageway. The only apparent difference between 1970 and today is the 1' deep, 2' wide channel now existing on the Lawton property, where our airphotos show it may have been an unchannelized flow previously. This may have some effect on the velocity of water reaching Dougan's property by moving it onto Dougan's faster than it dig' iously.
