City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />1. Applicants shall grant a Conservation and Flowage Easement to <br />the City over the pond area. <br />2. Ap•-icants and applicants' contractor shall provide <br />appropriate erosion control measures as required by the City <br />Inspector. <br />3. The pond banks and disturbed area shall be re -vegetated as <br />soon as feasible following completion of the excavation and <br />grading. <br />4. The applicants are advised that upon granting of a <br />Conservation and Flowage Easement over the pond, the pond becomes <br />a designated wetland subject to the 26' wetlands setback. No <br />future additions to the house at 440 Brown Road South may extend <br />closer than 26' to the edge of the pond. <br />5. The appliL •ts' contractor shall obtain a grading permit <br />prior to commencement of the work on the pond. <br />6. Violation of or non-compliance 4v;th any of the terms and <br />conditions of this resolution shall constitute a violation of the <br />zoning code, shall automatically terminate any authority granted <br />herein, and shall be punishable as a misdemeanor. <br />7. The undersigned applicant has read, understood and hereby <br />agrees to the terms of this resolution and on behalf of himself, <br />his heirs, successors and assigns, hereby agrees to the recording <br />of this resolution in the chain of title of the property. <br />Adopted by the Orono City Council on this loth day of <br />November, 1986. <br />AT^EST: <br />Dorothy M.
