City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #1070 <br />WHEREAS, Richard Rinehart (hereinafter "the applicant") is <br />the owner of the property located at 985 Old Long Lake Road within the <br />City of Orono (hereinafter "City") and legally described as follows: <br />The West 90 feet of that part of the East � of the Southeast 1/4 <br />of Section 35, Township 118, Range 23, Hennepin County, <br />Minnesota, lying North of Highway 12, except road, (hereinafter <br />"the property"); and <br />WHEREAS, the applicant h= , applied to the City for a <br />variance to Municipal Zoning Code Sec�ion 10.28, Subdivision 5 (B) to <br />permit the construction of an attached garage to be located 0.6 feet <br />from the side lot line where a 30 foot side yard setback is normally <br />required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1070. <br />2. The property is located in the RR-lB Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />October 20, 1986, and recommended approval of the proposed <br />variance based upon the following findings: <br />A) The applicant has constructed a slab located 0.6 feet <br />from the lot line. <br />B) The proposed garage on this slab can be contructed so <br />there will be no structural encroachment into the <br />neighboring yard. <br />C) The house on the adjacent affected property is at least <br />60' away, hence the rural character of the area will be <br />maintained. <br />D) The owner of the adjacent FffPcted property has <br />submitted a letter of non-objectic++ to `-paving the garage <br />near his property line. <br />Page 1 of 4 <br />
