Spates Avenue Lift Station <br />October 24, 1986 <br />Page 2 <br />3. Is a variance to 50' of abutting_ property a use variance or <br />performance standard variance? <br />In line with the comment on the Bjork application, it is a <br />performance standard variance (requesting Tom Barrett's <br />comments). <br />4. Was the cost of the lift station increase the assessment? <br />The assessment was spread on 6/10/85. The lift station <br />change was $3,512 (Change #1 was $5,000 in otal) and was <br />approved 7/22/85. The amount of that change w s within the 3% <br />contingency over the bid price that was assessed. <br />5. Was a public hearing required for the location change? <br />Had the City been aware of the requirement for the <br />conditonal use permit, a public hearing would have been <br />appropriate for the original location on the south side of the <br />street. If that conditional use permit was in process and <br />location chan(,ed to the north side, such may or may not require <br />an additiona" wring at Council direction. (Requesting Tom <br />Barrett's comments.) <br />6. Can Council grant an after -,the -fact permit to itself? <br />Have requested Tom Barrett respond to this question. <br />Recommendation: <br />Given that the Council did approve the location change in an <br />effort to minimize costs and speed construction together with <br />landscaping treatment to reduce annoyance, that the conditional <br />use permit and variances be approved. <br />
