A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.55, SUBDIVISION 8 <br />AND CONDITIONAL USE PERMIT PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 <br />FILE #968 <br />WHEREAS, John B. A. Idstrom, II (hereinafter "the <br />applicant") is the owner of the property located at 2580 Fox Street <br />within the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Lots 13 and 14, Auditors Subdivision No. 229, Hennepin County, <br />Minnesota (hereinafter "property"); and <br />WHEREAS, the applicant has made application to the City of <br />Orono to permit the construction of a private driveway through a <br />designated wetland, requiring a variance to Zoning ode Section 10.55, <br />Subdivision 8 and a conditional use permit per Section 10.03, <br />Subdivision 19. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #968. <br />2. The property is located in the RR-1B Single Fan :.y Rural <br />Residential Zoning District. <br />S. The property is approximately 13.50 acres in area. <br />4. The Orono Planning Commission reviewed this application on <br />February 18, 1986, and recommended approval of the requester <br />variance and conditional use permit for the driveway construction <br />through a designated wetland, based on the following findings: <br />A) The driveway crossing is proposed to be located where it <br />will cause the least disr— ' ' ,n of wetlands. <br />B) The Minnehaha Creek Watershed District has issued a <br />permit for the wetland crossing. <br />C) The driveway crossing through the wetlands is the only <br />feasible means of access to the proposed building site at <br />the north end of the property. <br />Page 1 of 4 <br />
