Mr. Mimms found this however not acceptable and is <br />appealing the decision. As indicated in Mr. Gaffron's memo Mr. <br />nimms was informed of the requirement three or four weeks ago, <br />but did not broach the subject again with staff until October 13. <br />It has been indicated to us that Mr. Mimms was aware of the <br />possible requirement several months prior. <br />RECOMMENDATION - While on the face of it, a survey is not <br />critical to the construction of this project, it is felt that the <br />policy is appropriate and that the survey should be required in <br />order that staff reduces the exposure to the City regarding <br />siting in all cases together with the fact that the City is not <br />placed in a position of discriminating between persons based on <br />approximations of the land owner attempting to avoid the expense. <br />Some recent cases the City has encountered that the property <br />owner has been as much as 30, 40 or 50 feet off from where they <br />claimed items were. <br />PROPOSED MOTION - Moved by _, seconded by _, the Orono Council <br />affirms the decision of the Administrator in the case requiring a <br />survey prior to progress beyond the slab for the property at 25 <br />South Brown Road.
