icLO.AO CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> j � NO. 7659 <br /> �kESHO4 <br /> A RESOLUTION <br /> APPROVING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 6.12.1450 <br /> FILE NO. LA25-000048 <br /> WHEREAS, on October 22, 2025, Ungerman Inc. (hereinafter the "Applicant"), on <br /> behalf of Aaron Goldsteen (hereinafter the "Owner") applied for a variance from the City <br /> Code for the property addressed 4680 North Shore Drive, Orono and legally described <br /> as: <br /> That part of Lots 79 and 80, "Tonkaview Gardens Hennepin County <br /> Minn." lying South of a line running West at right angles from a point in the East line of <br /> Lot 80 distant 203 feet North from the Southeast corner of said Lot 80. (hereinafter the <br /> "Property"); <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> variance from Orono Municipal Zoning Code Section 6.12.1450 for a rear setback variance for a <br /> 240-square-foot addition to an existing detached garage 10 feet from the rear property line <br /> where 30 feet is required; and <br /> WHEREAS, on November 17, 2025, after published and mailed notice in <br /> accordance with Minnesota Statutes and the City Code, the Planning Commission held a public <br /> hearing, at which time all persons desiring to be heard concerning this application were given <br /> the opportunity to speak thereon; and <br /> WHEREAS, on November 17, 2025, the Planning Commission voted 4 to 3 in <br /> favor of a motion to recommend denial of the variance as recommended by staff; and <br /> WHEREAS, on December 8, 2025, the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff and voted 3-2 in favor of a <br /> motion to direct staff to prepare a resolution with findings of approval for the application; and <br /> WHEREAS, on January 12, 2026 the City Council accepted the findings of the <br /> approval for the requested variances; and <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br /> Minnesota hereby approves the requested variance as described above based on one or more <br /> of the following findings of fact concerning the Property: <br />
