A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 AND <br />10.24, SUBDIVISION 5 (B) <br />FILE #1066 <br />WHEREAS, Ann L. Carson (hereinafter "the applicant") is the <br />owner of the property located at 1317 north Arm Drive within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Lot 3, Block 7, Saga Hill Revised, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied co the City for a <br />variance to Municipal Zoning Code Section 10.24, Subdivision 5 (B) and <br />10.22, Subdivision 2 to permit the construction of a room addition 7.7 <br />feet from the side lot line where a 10 foot setback is normally <br />required, and which addition and attached deck will exceed the 30% <br />hardcover iimitation in the 250-500' lakeshore setback zone. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1066. <br />2. The property is located in the LR-1B Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />September 15, 1986, and recommended approval of the proposed <br />varip-ce based upon the following findings: <br />The neighboring property to the south, aQ jacent to the <br />v, oposed addition, is higher in elevation and will <br />experience no infringement on light, air, or open space as a <br />result of the addition. <br />B) The additional hardcover can be offset by removal of <br />existing plastic under decorative rock beds. <br />4. The proposed additions and concurrent removal of equivalent <br />amounts of hardcover are expected to result in no increase in the <br />amount of run-off from the property. The neighbor to the north <br />has requested relief from the existing natural drainage pattern <br />towards her property. it is possible to partially re -direct <br />drainage further west to decrease the effect on the neighboring <br />residence. <br />Page 1 of 4 <br />
