3 - MB, City o'L Orono <br />room for parking under city --odes for a duplex. <br />Please understand, then, that the Applicant is not making <br />her appeal on the sole basis of hardship caused by past <br />limitations upon the use of her property. Neither is the <br />Applicant seeking use of her property Ps a duplex simply <br />because it would be more saleable, or hAp her to offset <br />expenses against more income potential (which, at her age, <br />is most definitely a consideration). <br />Mother most definitelv merits consideration of those fac- <br />tors by the Council, but thev are not of the essence in <br />her appeal. The Applicant's appeal is based squarely on <br />another premise --that IC -he most realistic use of her prop- <br />erty at 2259 Shadyvood Road is as a dup'2x. Aside from <br />the argument T have set forth as to its generic nature as <br />�Plex, there are other cogent reasons for such use: <br />• The building can only beconvertod to a sing_ e-family <br />home with an enormous expenditure of money unjusti- <br />fied by the substandard lot and proximity to both <br />highway and railroad. <br />• The building cannot revert back to its former com- <br />mercial ._. this in li.c-ht of the one-year lapse. <br />• Parts of the building could be adapted to prof.s- <br />sional use, or to a home business of a quiet nature. <br />But over time, this would likely present greater <br />problems to the City than simply granting a Variance/ <br />Conditional Use Permit for a duplex. <br />• Though given informal and formal opportunity to do <br />so, no neighbor has voiced an objection to the grant <br />ing of such a Permit. <br />Upon the basis of the Applicant's appeal and these reasons, <br />may I respectfully request that you grant the legal status <br />needed for the most realistic use of my Mother's property -- <br />that of a duplex. All things considered, I believe this <br />is the City's wisest and fairest course of action.
