Jungquist, owner, dry cleaning <br />plant and residential apartment 2nd floor. <br />3. 1976 - to present - Margaret Bjork - residence <br />and mother-in-law apartment 1st floor - no record <br />of conditional use permit for non -rental <br />apartment. <br />Review of Uses <br />Prior to 1963, the property served as both principal <br />residence and grocery store. In 1963, the City assessed 2 <br />residential sewer units against {_he property. Mr. Jungquist <br />replaced grocery store use with a dry cleaning plant and <br />maintained 2nd flour apartment as principal residence sometime in <br />1963 through 1976. In 1971, the City assessed 2 residential <br />water units against the property. In 1976, Mrs. Bjork assumed <br />ownership via a contract for deed. The address file for the <br />property provided staff with additional information on the <br />history of the property since 1976. Review Exhibits F, G & H. <br />In 1'76, the commercial use did not exist anc 1980 repermitting <br />confirmed that a commercial use still did not exist. Per <br />Sections 10.03, Subdivision 5 A through J - a commercial use <br />would not be allowed to be resumedwithin the structure. <br />The permits and floor plans confirm that permits were: issued <br />to convert commercial area of structure into a mother-in-law <br />apartment. Note the permits state that apartment could not be <br />used as rental apartment. A conditional use permit was not <br />required in 1976 - Section 10.20, Subdivision 3 (G) requires a <br />conditional use permit for guest apartments - the code has not <br />been amended since 1976. <br />The applicant's son has advised that at one time Mrs. Bjork <br />attempted to sell the property as a duplex and the prospective <br />buyer sued when advised by the City that structure was not <br />considered a legal duplex. <br />When the original permits were issued in 1.976 and once again <br />in 1980 to the Bjorks, the City was advised that one of Mrs. <br />Bjork's sons would reside in the second floor apartment with his <br />family and Mrs. Bjork, because of her age, would reside in the <br />first floor apartment. Neighbors have confirmed that Mrs. Bjork <br />has resided in the apartment until her move to Spring Park. <br />Staff has no information on the use of the second floor apartment <br />from 1976 to present. <br />Staff has had at least 2 contacts from prospective buyers, <br />within the last few yt•ars, interested in the use of the structure <br />as both a residence and space for home occupation. <br />Unfortunately, the hose occupations did not satisfy standards for <br />such use. <br />
