City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION ORDERING ABATEMENT <br />OF HAZARDOUS BUILDING ACTION AT <br />3536 LYRIC AVENUE, ORONO <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, Richard Bowman Gilmore, Richard Robert Gilmore, <br />Mary Ellen Anthony and Audry S. Gilmore are the owners and Charles <br />Lewis Henke has an interest in the property located at 3536 Lyric <br />Avenue, Orono, Minnesota, herein referred to as "the property", and <br />legally described as follows: <br />Lots 19 & 20, Block 4, "Navarre Heights", Hennepin County, <br />Minnesota (P.I.D. 17-117-23 43 0056); and <br />WHEREAS, the City Council of the City of Orono, having duly <br />considered the matter pursuant to Minnesota Statutes Sections 463.15 <br />to 463.261, hereby finds that the above described property is <br />uninhabitable and contains unsanitary and hazardous conditions which <br />constitute a public nuisance and which makes this property hazardous <br />to the public health, safety and welfare based on the following <br />findings: <br />1. Over two layers of roofing; <br />2. Improper footings - concrete block stacked without mortar - <br />improper depth; <br />3. Building is in a state of deterio-aticn and dilapidation, <br />thus it is a safety and health hazard pursuant to Minnesota State <br />Building C'odP/Uniform Building Code, Section 203. <br />4. Orders to remove or repair the structure were issued by the <br />Building Official on February 19, 1985 and September 10, 1986. <br />These orders have not been complied with. <br />NOW, THEREFORE, BE IT RESOLVED as follows: <br />1. That the City Council of the City of Orono, pursuant to the <br />foregoing findings and in accordance with Minnesota Statutes <br />Sections 463.15 to 463.261 hereby orders the owner(s) of the <br />property to raze or repair the structure on the property. The <br />Council further orders that all personal property or fixtures <br />that may unreasonably interfere with the razing or repair be <br />removed within twenty ( 20 ) days of the . -rvice of this order or <br />the City of Orono may remove such personal property or fixtures. <br />All costs incurred shall be charged to the property owner(s) in <br />accordance with the law. <br />Page 1 of 2 <br />
