A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 & 2 <br />FILE #1075 <br />WHEREAS, Joseph Durda (hereinafter "the applicant") is the <br />owner of the property located at 3135 North Shore Drive within the <br />City of Orono (hereinafter "City") and legally described as follows: <br />Tract A, Registered Land Survey No. 1113, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Sections 10.22, Subdivision 1 & 2 <br />and 10.55, Subdivision 8 to permit the construction of a balcony and <br />after -the -fact construction of a deck, both located less thar_ the <br />required 75' setback from the lakeshore, and constituting structural <br />hardcover in the 0-75' lakeshore setback zone where no hardcover is <br />norma 11 y a 11 owed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1075. <br />2. The property is located in the LR-lB Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planninq Commission reviewed this application on <br />September 15, 1986, and recommended approval of the proposed <br />variance based upon the following findings: <br />A) The existing residence on the property was cons'-ructed <br />in 1973 prior to the 1975 zoning code 75' `back <br />requirement, and is located approximately 42' the <br />lagoon on the property, the shoreline of which is cu' tiered <br />by the City to be the lakeshore of Lake Minnetonka. <br />B) Lot area in the 0-75' lakeshore setback zone is 31,300 <br />s.f. of which 3,527 s.f. or 11.27% is covered with <br />impervious surfaces (hardcover). Lot area in the 75-250' <br />lakeshore setback zone is 13,300 s.f. of which 5,873 s.f. or <br />44.2% is hardeovered. <br />Page 1 of 4 <br />
