A RESOLUTION GRANTING <br />A VARIANCE PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.08, SUBDIVISION 3 (A)7 <br />FILE #1068 <br />WHEREAS, Dr. Glen Nelson (hereinafter "the applicant") is the <br />owner of the property located at 500 Tonkawa Road within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Tract B, Regi-,tered Land Survey No. 1305, Hennepin County, Minnesota <br />(hereinafter ie property"); and <br />WHEREAS, the applicant has applied to the City for a valiance per <br />Municipal Zoning lode Section 10.08, Subdivision 3 (A) 7 to permit the <br />construction of a non -rental guest apartment attached to the residence at <br />500 Tonakwa Road. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1068. <br />2. The property is located in the LR-lB Single Fe 'I.y Lakeshore <br />Residential. Zoning District. <br />3. The Ororo Planning Commission reviewed this application or <br />September 15, 1986, and recommended approval of the proposed variance <br />based upon the following findings: <br />A) The current and intended use of the property is primarily for <br />a single family residence, and that the guest apartment use is <br />intended to serve multiple purposes, including housing of over- <br />niqnt guests and live-in help, and to serve as a staging area <br />for entertaining. <br />B) The residence is on a property containing 3.66 acres in area, <br />and the proposed guest apartment usi is compatible with the <br />surrounding properties. <br />4. The City Council has considered this application including the <br />findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicant and the eLfect of the proposed <br />variance on the health, safety and welfare of the community. <br />Page 1 of 3 <br />
