A RESOLUTION GRANTING <br />A VARIANCE TO <br />[MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 6 (B) <br />FILE #1067 <br />WHEREAS, Herbert T. Olson (hereinafter "the applicant") is <br />the owner of the property located at 3640 Bayside Road within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Lot 1, Block 1, Riedel's Stubbs Bay Addition, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.23, Subdivision 6 (B) to <br />permit the construction of a room addition to be located 19.9 feet <br />from the side lot line where a 30' side yard setback is normally <br />required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1067. <br />2. The property is located in the 1,I-1A Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />September 15, 1986, and recommended approval of the proposed <br />variance based upon the following findings: <br />A) Location of the proposed addition to the west side of <br />the existing house is a result of hardships to other <br />locations due to steep slopes, existing trees, drainage, <br />location of the well, and the existing room layout in the <br />house. <br />B) The house was constructed prior to the recent "Riedel's <br />Stubbs Bay Addition" subdivision which did not anticipate a <br />westward expansion of this house, and which created the lot <br />line just west of the house to maintain a 2 acre lot size in <br />the westerly lot. <br />4. The proposed addition will not in any way limit the <br />development of the adjacent Lot 2, Block 1 Riedel's Stubbs Bay <br />Addition. <br />Page 1 of 4 <br />
