MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, October 16, 2000 <br />(#2627 Willmar Thorkelson, Continued) <br />Waldron commented due to the minor encroachment, he does not think removing that portion <br />of the shed within the setback is necessary. <br />Stoddard inquired why a building permit was not obtained prior to construction. <br />Mrs. Thorkelson stated it was her understanding her son would take care of everything and did <br />not inquire whether a building permit had been obtained. <br />Kluth inquired what her son's profession is. <br />Mrs. Thorkelson stated he does some woodworking and different projects. <br />Kluth noted since he does work in the construction industry, he should have been aware ofthe- <br />building permit process. <br />Lindquist moved, Kluth seconded, to recommend denial of Application #2627, <br />Willmar Thorkelson, 440 Big Island, for granting of an after-the-fact variance to permit <br />a storage shed to remain on the property, with the understanding that the Applicant <br />has the option to bring the structure into compliance with the City's existing ordinances <br />or remove the building. VOTE: Ayes 3, Nays 3, Nygard, Stoddard and Berg Opposed. <br />Hawn commented this application will proceed to the City Council. <br />Stoddard stated in his opinion this was the proper motion to make on this application, noting <br />that the residents of Big Island need to be sent a message that they need to comply with Orono's <br />rules and obtain the necessary building permits. Stoddard recognized that the portion of the <br />building into the setback is very minor and that the roadway is not a standard roadway. <br />Nygard stated he does not have a problem with the encroachment. <br />(Hawn excuses herself from the remainder of tonight's meeting at 8:42 p.m.) <br />(Commissioner Dale Lindquist chaired the remainder of the meeting.) <br />(#13) #2628 ROGER ANDERSON, 2200 SHADYWOOD ROAD, VARIANCE, <br />8:43 p.m -8:47 p.m. <br />Roger Anderson, Applicant, was present. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />Bottenberg stated the Applicant is proposing to tear down and construct a house and detached <br />garage on a lot that does not meet lot area or lot width requirements. The lot is 16,941 square <br />feet where 21,780 square feet is the minimum lot are for the LR-IC zoning district. The lot is <br />served by sanitary sewer and currently has a house and detached garage on it. Lots of one <br />PAGE 19
