Representing staff were Planning <br />Director Mike Gaffron, Planners Melanie Foth and Janice Waataja, Recorder Kristi <br />Anderson and City Council liaison Jim White. · <br />Chair Smith caUed the meeting to order at 6:QO .P.M. <br />CONSENT AGENDA <br />(#1) #03-2935 SCOTT AND KARA HUTTON, 1835 SHADYWOOD ROAl), . <br />VARIANCE . <br />Mabusth moved, Hawn seconded, to table Application #03~2935, Scott and Kara <br />Hutton, 1835 Shadywood Road, to the October meeting at the request of staff. <br />VOTE: Ayes 7, Nays 0.. . <br />(#2) #03-2939 PE~E AND MAXINE THORKELSON, 440 BIG ISLAND, <br />CONDITIONAL USE PERL'1IT. <br />Mabusth moved, Iiawn seconded, to recommend Approval of Application #03-2939, <br />Pete and Maxine Thorkelson, 440 Big Island, a request for a Conditional Use Permit <br />to aliow septic system improvements in street right of way provided the following <br />conditions are met: The applicant acknowledges that placement of septic system . <br />connection pipes within the right-of-way is at their own risk and the applicant shall, <br />prior to placement of improvements within the right-of-way, execute a hold harmless <br />agreement which releases, indemnifies and holds harmless the City and the public • <br />from any and all daims or causes of action arising out of the use or alteration of the <br />platted right-of-way by applicant and their invitees.
