�_ , <br /> � <br /> � k�� Clt o� ORONO <br /> . l �' <br /> � RESOLUTION OF THE CITY COUNCIL <br /> ��� 1"497 � <br /> y ;'� NO. <br /> � A RESOLUTION APPROVING TAE REOPENING OF <br /> • � • ` PARTENWOOD LANE AS A PUBLIC ROAD <br /> WHEREAS, on June 15 , 1978 , upon petition of the property owners with <br /> interest in Partenwood Lane, the City Council of Orono approved Resolution #907 <br /> vacating all of Partenwood Lane in the City of Orono, Minnesota ; and <br /> � WHEREAS, Resolution #9�7 reserved the right of the City to reopen <br /> Partenwood Lane at some future date per the following condi.tions : <br /> "Providing there is at that time a showing of public need and that all of <br /> , the procedures required by law for the establishment of streets shall <br /> be followed" ; and <br /> WHEREAS, Norma Johnson, Richard C. Erickson and Sandra K. Erickson, <br /> (hereafter "owners") persons with shared ownership in Partenwood Lane, have <br /> petitioned the City to reopen Partenwood Lane as a public road and to "commence the. <br /> care and maintenance of said Partenwood Lane" . <br /> � NOW, THEREFORE, BE IT RESOLVED that such petition is �hereby granted and <br /> the said Partenwood Lane, as originally described in that certain plat of <br /> Partenwood , filed of record under date of December ?.2, 1972, is hereby reopened <br /> subject to the following conditions: <br /> 1. The execution of a Developer ' s Agreement providing for certain <br /> improvements to Partenwood Lane in order to bring the road up to current <br /> City standards for a public road . The City will assume all <br /> responsibil9.ty for the maintenance and care of the improved road no <br /> earlier that June 30, 1984, and only upon a satisfactory inspection by <br /> the City Engineer to assure that all improvements have been installed <br /> and completed . <br /> 2. Owners shall grant the appropriate deeds to the City for the ' <br /> entire area of Partenwood Lane as orginially described in the plat of <br /> Partenwood , filed of record under date of December 22, 1972, to ensure <br /> adequatetitletotheCity. Ownersshallsubmit the appropriate title <br /> opinion showing proof of title and right of owners to transfer <br /> ownership of the road to the City. <br /> Adopted by the City Council of the City of Orono, Minnesota at a regular meeting <br /> held June 13, 1983 . . <br /> • � <br /> Ma y C.
