MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, July 18, 2005 <br />6:00 o'clock p.m. <br />4. #05-3128 GREGORY O'CONNOR AND RICHARD FRUEN, 400 AND 410 BIG ISLAND, <br />LOT LINE REARRANGEMENT, 6:07 P.M. -6:07 p.m. <br />Gregory O'Connor, Applicant, was present. <br />Jurgens inquired why the encroachment is not being eliminated or reduced. <br />Gaffron stated the 1.4-foot encroachment goes back approximately 20 years but was never formally <br />approved by the City. · <br />Rahn moved, Bremer seconded, to recommend approval of Application #05-3128, Gregory <br />O'Connor and Richard Fruen, granting of a lot line rearrangement for the properties located at <br />400 and 410 Big Island. VOTE: Ayes 7, Nays 0. <br />5. #05-3133 BRUCE AND ELIZABETH NUSBAUM, 3480 NORTH SHORE DRIVE, <br />VARIAN CE, 6:08 P.M. -6:29 P.M. <br />Elizabeth and Bruce Nusbaum, Applicants, were present. <br />Rahn stated to his recollection he does not remember the Planning Commission ever approving a side <br />setback variance of 3. 7 feet for a new accessory sh'ucture without there being some type of hardship being <br />demonstrated. Rahn noted this lot is already over in strnctural coverage and stated that he has concerns <br />with the proposed structure being a story and a half. Rahn indicated he would recommend that the <br />building meet the I 0-foot side yard setback requirement if it is going to be a story and a half and that the <br />size of the structure be limited to 440 square feet. <br />Rahn stated he might be willing to approve a side setback variance if the garage were the standard height <br />but that he is not willing to approve the present proposal. Ralm stated in his opinion the driveway sho1,1ld <br />also be 20 feet in length from the curb to the garage door in order to allow a full-size vehicle to park in <br />that area. <br />Curtis pointed out there is 20 feet from the proposed garage to the curb cut. <br />Mr. Nusbaum indicated it is 18 feet to the property line from the proposed garage. <br />Ralm stated he had the understanding there was a 15-foot rear yard setback being requested. <br />Curtis indicated there is approximately 20 feet from the curb cut to the garage due to the angle of the <br />property. <br />Gaffron recommended making the 20-foot driveway from the edge of the roadway to the edge of the <br />garage a condition of approval. <br />PAGE2
