' <br /> , c) The proposed improvement is consistent with pattern of development <br /> within the surrounding neighborhood . <br /> d) The location and use of the proposed structure will have no adverse <br /> effects on the surrounding properties, existing surface drainage <br /> pattern nor wi.11 it have detrimental effects on the property values, <br /> within the surrounding neighborhood . <br /> . 7. The City Council hasconsidered thisapplicationincluding thefindings <br /> and recommendations of the Planning Commission, reports by City staff , <br /> comments by the owner and other interested persons, and the effect of the <br /> proposed variance on the health , safety and welfare of the community. <br /> : 8 . The City Counci.l finds that the conditions existing on this property are <br /> , peculiar to it and do not apply generally to other property in this zoning <br /> district : that granting the variance would not adversely effect traffic <br /> conditions , light, air nor pose a fire hazard or other danger to neighboring� <br /> property; would not merely serve as a convenience to the owner , but is <br /> necessaryto alleviate a demonstrable hardship or difficulty; is necessary <br /> to preserve a substantial property right of the owner ; and would be in <br /> keeping with the spirit and intent of the zoning code and comprehensive plan <br /> of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings , the Orono City Council hereby grants variances to <br /> Section 34. 552, 34 .610 and 38 . 201 to allo� construction of a detached garage <br /> within 3 feet of the interior side property line , 10 feet from the front/street <br /> property line and to approve an.existing hardcover varaince of 2024 squ�re feet or <br /> 31 .5$, subject to the following conditions: . <br /> l . Any doors over 3 feet wide shall face away from the street. <br /> , 2. No other variances are granted or permitted for this <br /> structure. <br /> 3 . The City will approve no future variances for this property. <br /> • 4 . Authorities granted by this variance run with the property not with the <br /> owner , but are, permissive only and must be exercised by application for a <br /> building permit and/or occupancy certificate within one year of the date of <br /> Council approval , or this variance will expire on that date (June 14, 1984) . <br />
