How did Mr. Eiden's guest cabin come to be located in the right of way of Meta-Comet <br />Avenue? <br />It was constructed before there were effective zoning and building controls on Big Island. The <br />guest cabin can be seen on aerial photos from 1955. There are other buildings within City right of <br />ways. 360 and 370 Big Island were located in the section of Massasoit Avenue that was vacated <br />and 380 is within the right of way. One way to resolve the situation, if Mr. Hanson's request is <br />granted, would be to vacate he section Meta-Comet A venue on which the cabin stands <br />Shouldn't Mr. Hanson have to pay for the land the City is giving him? <br />This right of way was given to the public to use as a street by the owner of the land who subdivided <br />it into lots. A vacation is a determination that there is no longer a public need for the right of way. <br />The appropriate property owners can then claim title to the property. <br />Is there any justification to "trade" the portion of right of way to be vacated for an equally <br />sized strip situated along Mr. Hanson's west boundary? <br />If Meta-Comet A venue actually extended to the lakeshore and provided access, this might be <br />justified. There are precedents in Orono for lake access vacation approval offset by dedication or <br />deeding of an equal access nearby. However, since Meta-Comet Avenue doesn't provide access to <br />the shore the need for a tradeoff is questionable. Also, the cabin on the property to the west is very <br />close to the property line, with a portion of its chimney actually on Mr. Hanson's property.
