Buyers shall have determined, on or before the Contingency Date, that <br />he is satisfied with the results of.and matters disclosed by such soil tests of the Real <br />Property as Buyers may deem necessary, all such tests to be obtained at Buyers' sole <br />cost and expense. Seller shall deliver to Buyers all soil tests and other inspections, <br />reviews and reports pertaining to the Real Property that are in Seller's possession or <br />control or have been previously prepared on Seller's behalf. <br />c. Road and Utilities. Buyers shall have determined, on or before the Contingency <br />Date, that the Real Property is serviced by all necessary utilities in order to support <br />Buyers' intended use without cost to Buyers and that the Real Property has adequate <br />unrestricted aecess to a public road. <br />f. Buyers' Apm:ai1?fl). Buyers shall have reviewed and approved of all items to be <br />provided to Buyers as herein provided. <br />g. A(}{Jitional Document~. Seller shall have furnished to Buyers, and Buyers shall <br />have reviewed and approved of the current real estate ta'( statement for the Real <br />Property and a current Special Assessment Search from the City of Orono. <br />h. On or before the Contingency Date, Buyers shall have detem1ined that the Real <br />Property is suitable for Buyers' intended use thereof and that such intended use is or <br />will pe1n1itted under the Zoning, Subdivision and Land Use Regulations of the City <br />of Orono or that any such variance or special use pennit shall be granted by the City <br />of Orono. <br />The "Contingency Date" sha11 be July 31, 1998. If any of the above contingencies have not been <br />satisfied on or before the Contingency Date or the applicable date(s) stated in this Section 3, as the <br />case may be, then this Agreement may be terminated, at Buyers' option, by written notice from <br />Buyers to Seller. Such notice of termination may be given at any time on or before the applicable <br />date. Upon such termination, the Earnest Money shall be refunded to Buyers and upon such return, <br />neither party will have any further lights or obligations regarding this Agreement or-the Real <br />Property. All the contingencies set forth in this Agreement are specifically stated and agreed to be <br />for the sole and exclusive benefit of the Buyers and the Buyers shall have the right to unilaterally <br />waive any contingency by written notice to Seller. In addition, both the Buyer and Seller shall have <br />the absolute right to tem1inate this Agreement on or before the Contingency Date.
