When completed the lakeshore bank will be at a grade that <br /> will allow easier maintenance and decreases the potential <br /> for erosion of lakeshore bank. <br /> � 10. The City engineer in his report, dated 4-18-83 , finds no <br /> significant impact on quality and quantity of runoff as <br /> a result of the proposed construction. and land alteration. <br /> � 11. In that same report, the City engineer finds the proposed <br /> land altera.tion does not affect the neighboring properties . <br /> 12 . The City has received no negative comments from the surrounding <br /> • property owners notified during the review of application No. 741 . <br /> 13 . The City Council has considered` this application including the <br /> findings and recommendations of the Planning Commission, .reports <br /> .. by staff and comments of the applicant and the effect of the � <br /> proposed land alteration on the health, safety and welfare of <br /> the community. <br /> � 14 . The City Council finds that granting a Conditional Use Permit <br /> to alter the lakeshore bank as proposed. will not be detrimental <br /> . to the health, safety or general welfare of the public, would <br /> ' not adversely affect light, air .nor pose a fire hazard or other <br /> . danger t.o neighboring. properties, nor will it depreciate surround- <br /> ing property values and. that the land alteration and the manner <br /> . in which the excavation� is to be carried out to be in keeping <br /> with the intent and objectives of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> 15.' The City Council finds that granting a variance for the land <br /> alteration as proposed as necessary to alleviate a demonstrable <br /> hardship, is necessary to preserve a substantive property right <br /> �• of the owner and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. <br /> r, <br /> • . <br />
