Hennepin County DOTmaintains the road <br /> shoulder and grassed ditches between the travelled road and <br /> this £ence line . <br /> k) South of the driveway into the Gregory property on the west <br /> side of the road the topography becomes steeper and ditches <br /> are narrower and are eliminated entirely along the steep <br /> hillside a].ong the Duff property. Hennepin County DOT <br /> maintains this area to approximately 27. 5 feet from the • <br /> � travelled centerline . <br /> 19. Public use of the subject Browns B�y shoreline on Lake Minnetonka <br /> for other than roadway purposes has been evidenced as follows: <br /> a) The subject snoreline is about 85� feet in length divided as . <br /> follows : <br /> 1� About 50 feet (5�) within the "reserve" lot privately <br /> owned by Gregory. � <br /> 2) About 550 feet (65$) in unplatted Section ].1 along the <br /> Gregory and Duf.f properties , all of which is within 33 feet <br /> of the travelled centerline of County Road 15, and a11 of <br /> which has been maintained by Hennepin County DOT as noted <br /> above. <br /> 3) �bout 25l� feet (29�) between the above areas in Section 2, <br /> �11 of which was created from the bed of Lake Minnetonka when <br /> the roadway w�s relocated prior to 1940 and all of which has <br /> been maintained by Hennepin County DOT. But this area is <br /> � more than 33 feet from the travelled centerline and it is not <br /> included within the right-of-way of the recorded highway <br /> plat nor is it within the originally platted "reserve" lot. <br /> Ownership of this acretion area is lega.11y disputable. <br /> • b) The entire 850 feet o.f shoreli.ne has been used bymembers of <br /> the public For .fishing access for as long as anyone has been <br /> 7 of 20 � <br />
