_ -- ;. , <br /> .� <br /> o d <br /> _ C�t� o� ORONO <br /> '`���� RESOLUTION OF THE CITY COUNCIL <br /> ���' ' NO. 14 7 6 <br /> V/ ��j,`:C�Y,.7k . . <br /> � � � � <br /> A RESOLUTION APPROVING A BUILDING PERMIT <br /> FOR JAMES DONGOSKE TO CONSTRUCT A DOCK ON <br /> LOT 6 , BLOCK 2, FOREST ARMS PLAT <br /> WHEREAS, the Planning Commission and City Council have reviewed <br /> a request of James Dongoske to construct a dock on that portion of his <br /> property abutting Forest Arms Channel; and <br /> . WHEREAS, James Dongoske must obtain a building permit from <br /> the City of Orono to construct said dock. <br /> NOW, THEREFORE BE IT RESOLVED that based upon .the. recommen- <br /> dation of the Planning Commission and th� report of the Orono staff, <br /> the City Council hereby makes the following findings of fact: <br /> l. That on February_ 3 , 1966, John Gullickson did make <br /> application to the DNR for a permit to- "dredge a channel � <br /> � along the shoreline for boat access" . <br /> 2 . That on April 26, 1966, the DNR issued a. permit to John <br /> Gullickson to "excavate and remove silt and earthen material <br /> from the bed of Forest Lake to elevation 925.0 S.L.O. in <br /> construction of a channel along the shoreline of said <br /> lake and on applicant's property to be 1,300 feet long <br /> • having a 20 foot bottom with 3 :1 slopes on and abutting. . . . <br /> for the purpose of improving navigation facilities" . <br /> 3 . Lot 6, Block 2, Forest Arms Plat has approximately 143 ' of <br /> shoreline abutting the Forest Arms Channel. • <br /> 4 . As of April 11, 1983 , Forest Arms Channel is navigable . <br /> and riparian to Lake Minnetonka. <br /> 5. The granting of the application will allow the property <br /> owner the immediate use of the available channel but <br /> does not in and of itself constitute the granting of a <br /> vested right to redredge this channel. <br /> 6 . To issue a permit for the proposed, limited dock constructior <br /> will not in any way impair the public health, safety, <br /> comfort, morals or general welfare. <br /> • 7. The granting of this building permit will not be contrary <br /> to the intent and objectives of the zoning code and <br /> Comprehensive Land Use Plan. � <br />
