The City Council has cons'idered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff, comments by the owner and other interested <br /> persons , and the effect of the proposed variance on the health , <br /> safety and welfare of the community. � <br /> 5 . The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> . property in this zoning district: that granting the variance <br /> would not adversely effect traffic conditions , light , air nor <br /> pose a fire hazard or other danger to neighboring property; would <br /> • not merely serve as a convenience to the owner , but is necessary to <br /> alleviate ademonstrable hardship ordifficulty; isnecessary to <br /> preserve a substantial property right of the owner ; and cvould be <br /> in keeping with the spirit and intent of the zoning code and <br /> . comprehensive plan of the City. ' <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings , the Orono City Council hereby grants <br /> variances to Section 34.452 to allow construction of a new residence on <br /> the property consisting of 22, 525 square feet instead of the required <br /> 43,550 square feet, with a lot width of 10� feet instead of the required <br /> 140 feet and with a south side yard setback of 6 feet instead of the <br /> •required 1.G1 feet, subject to the following conditions: <br /> 1 . All existing structures on property must be removed prior to <br /> the issuance of a building permit for the new residence. A <br /> demolition permit must be obtained from the City prior to <br /> removing these structures . <br /> ' <br /> , 2. New residence must be hooked to municipal sewer , a <br /> Metropolitan Service Availability charge has been paid . <br /> 3. No other variances are granted or permitted for this , <br /> structure. <br /> • 4 . Authorities granted by this variance run with the property <br /> not with the owner , but are permissive only and must be exercised <br /> by application for a building permit within one year of the date of <br /> Council approval , or this variance will expire on that date <br /> (April 11 , 1984) . ' <br />
