A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #1071 <br />WHEREAS, Colin Kelly and Lona Jane Shaughnessy <br />(hereinafter "the applicants") are the owners of the property <br />located at 95 Brown Road South within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lot 2, Block 1, Kelley Green, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a <br />variance to Municipal Zoning Code Se :tion 10.28, Subdivision 5 <br />(B) to permit the constructin of a single family residence to be <br />located 37.3 feet from the front lot live and 33.9 feet fr ^ the <br />rear lot line where front and rear yard setbacks of 50 fE I e <br />normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This applicatioiâ–º was reviewed as Zoning File #1071. <br />2. The property is located in the RR-1B Single Family <br />Rural Rer tential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on September 15, 1986, and recommended ar prova l of the <br />proposed variances based upon the following findings: <br />A) The narrowness of this recently created lotis a <br />hardship in that it leaves little flexibility in <br />locatinc; the house to fit the landscape. Under code <br />requirements the allowable building envelope without <br />variances is only 44' deep. <br />Page 1 of 4 <br />
