In 1963, the City assessed 2 <br />residential sewer units against the property. Mr. Jungquist <br />replaced grocery store use with a dry cleaning plant and <br />maintained 2nd floor apartment as principal residence sometin, in <br />1963 through 1976. In 1971, the City assessed 2 residential <br />water units against the property. In 1976, Mrs. Bjork assumed <br />ownership via a contract fo:.• deed. The address file for the <br />property provided staff ,V- additional information on the <br />history of the property si 976. Review Exhibits F, G & H. <br />In 1976, the commercial use u.d not exist and 1980 repermtting <br />confirmed that a commercial use still did not exist. Per <br />Sections 10.03, Subdivision 5 A through J - a commercial use <br />would not be allowed to be resumedwithin the structure. <br />The permits and floor plans confirm that permits were issued <br />to convert commercial area of structure into a mother-in-law <br />apartment. Note the permits state that apartment could not be <br />used as rental apartment. A conditional use permit was not <br />required in 1976 - Section 10.20, Subdivision 3 1G) requires a <br />conditional use permit for guest apartments - the code ras not <br />been amended since 1976. <br />The applicant's son has advised that at o. ,p Mrs. Bjork <br />attempted to sell the property as a duple:- an(. prospective <br />buyer sued when advised by the City that structure was not <br />considered a legal duplex. <br />When the original permits were issued in 197v and once again <br />in 1980 to the Bjorks, the City was advised that une of Mrs. <br />;ork's sons would reside in the second floor apartment with his <br />..ami 1 y and Mrs. Bjork, because of her age, -)u ld reside in the <br />first floor apartment. Neighbors hav_ confirmed that Mrs. Bjork <br />has resided in the apartment until her move to Spring Park. <br />Staff has no information on the use of the second floor apartment <br />from 1976 to present. <br />Staff has had at least 2 contacts from prospective buyers, <br />within the last few years, interested in the use of the structure <br />as both a residence and space for home occupation. <br />Unfortunately, the home occupations did not satisfy standards for <br />such use. <br />
