A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.55, SUBDIVISION 8 AND <br />SECTION 10.03, SUBDIVISION 19 <br />AND GRANTING A CONDITIONAL USE PERMIT PER <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #1046 <br />WHEREAS, Douglas Zumbusch (hereinafter "the applicant") is <br />the owner of the property located at 1535 Long Lake Boulevard within <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Log 19, Block 1 Albee's Long Lake Addition, Hennepin County, <br />Minnesota (hereinafter "property"); and <br />WHEREAS, the applicant has made application to the City of <br />Orono to permit the construction of a stairway and retaining walls <br />constituting 223 s.f. (4.8%) structural hardcover within 75' of the <br />lakeshore where such structures and hardcover are not normally <br />allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This app] :.-ation was reviewed as Zoning File #1046. <br />2. The property is located in the LR-lA Single Family Lakeshore <br />Residential Zoning District. <br />3. The property is approximately 0.22 acres in area. <br />4. The Orono Planning Commission reviewed this application on <br />August 18, 1986, and recommended approval of the proposed <br />variances to Section 10.22, Subdivision 2 and 10.55, Subdivision <br />8 and a conditional use permit per Section 10.03, Subdivision 19 <br />based on the following findings: <br />A) The steep slopes of the lakeshore yard necessitate the <br />stairway for safe access to the lakeshore. <br />B) The retaining walls proposed are necesary for protection <br />of the existing vegetation on the property and for safety of <br />the occupants when mowing the lawn. <br />Page 1 of 4 <br />
