Schall, 605 Park Lane - <br />Variance - Resolution <br />List of Exhibits - <br />A - Legal Opinion re: Granting of Variances <br />B - Originally drafted Resolution <br />C - Height, Layout Sketches <br />D - Memo of 8/20/86 <br />E - Minutes of 8/25/86 Council Meeting <br />This i.t '-1 was tabled at your last meeting pending the City <br />Atto review of the recuirements for granting of variances. <br />That 1 opinion has been received and is attached as Exhibit <br />A. <br />Note the 4 criteria listed in Exhibit A (items B-1 through B-4) <br />which must. be met in order to grant variances. <br />The comment was made at the last meeting that the hardships <br />stated in the draft resolution were a little weak. It is up to <br />the Council to determine and decide whether the demonstrated <br />hardships are sufficient to warrant granting of the variance. <br />The hardships claimed or demonstrated by applicant (compiled by <br />staff) are as follows: <br />1. Existing 1-car garage is inadequately sized for <br />applicants reasonable use of the property. <br />2. Existing 1-car garage exits directly to street in unsafe <br />manner. Side l.oadi:ig proposed 2-car garage will be saft <br />for applicant and neighborhood, and will decrease thc <br />existinc; encroachment on the street setback. <br />3. There is no other location on the property than the <br />location proposed to construct a 2-car garage due to <br />proximity of neighboring houses, location of existing house <br />on the lot, and location of lakeshore. <br />4. The second story room over the garage is necessary to <br />provide a useful second bedroom since the house currently <br />contains only cne useful bedroom, which is a hardship to the <br />applicant's reasonable use of the property, because it does <br />not allow for additional family members or temporary guests. <br />
