12. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by staff and comments of the applicant and the: effect of <br />the proposed use on the health, safety and welfare of the <br />community. <br />13. The City Council finds that granting a conditional use permit <br />to allow the guest house use of the existing residence at 3725 <br />Watertown Road will not be detrimental to the health, safety or <br />-ineral welfare of the public, would not adversely affe.t light, <br />r nor pose a fire hazard or other danger to neighboring <br />..operties, nor will it depreciate surrounds: f property values <br />and that the proposed level of use of the property will be in <br />keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby grants a conditional use permit per Municipal Zoning <br />Cede Section 10.20, Subdivision 3 (G) to permit the guest house use of <br />the existing residence located at 3725 Watertown Road and a lot <br />standards variance to the requirements of Section 10.20, Subdivision 3 <br />(G), subject to the following conditions: <br />1. This approval will be effective upon legal combination of <br />Parcels A and B into one single tax parcel. <br />2. The residence at 3725 Watertown Road is considered as a guest <br />house, may not be rented, and is for the sole use of the <br />occupants of the principal residence at 3685 Watertown Road and <br />their domestic employees or non-paying guests, including Arlie <br />Thorpe as a life -estate tenant. <br />3. Applicant is placed on notice that a future re• -subdivision <br />into two separate building sites might not be approved by a <br />future City Council because a number of variances would be re- <br />quired under current zoning code lot standards. <br />C. Applicant is placed on notice that the maximum allowable <br />i.umber of horses on the combined property is 7 horses. <br />5. Violation of or non-compliance with any of the terms and <br />conditions of this resolution shall constitute a violation of the <br />zoning code, shall automatically terminate any authority granted <br />herein, and shall be punishable as a misdemeanor. <br />Page 3 of 5 <br />
