By this letter, we request that there be an extension of the <br />preliminary plat approval granted by the City of Orono. <br />Our request for extension is based upon the following facts: <br />1. During the past winter, the upper watershed improvement project of the <br />Minnehaha Creek Watershed District was completed across Mr. Winters' land. <br />The excavation done by the project was completed across an area for which the <br />watershed district had no prior approval. As a result, the wetlands located on <br />Mr. Winters' property have been adversely affected and the value of his <br />property has been substantially diminished. We are currently seeking resolution <br />of this matter with the Minnehaha Creek Watershed District. <br />2. As a result of the actions of the Minnehaha Creek Watershed District prior <br />wetlands no longer exist. <br />3. Prior to the current situation, the City of Orono had requested that a <br />culvert be placed under the road and proposed private driveway which will reach <br />a portion of the proposed development. At the present time, it is difficult to <br />determine whether a culvert would be needed or, if needed, the size of the <br />culvert. We are conferring with the Minnesota Department of Natural Resources <br />regarding this matter. <br />
