Kamm, 755/763 North Ferndale Road - <br />Subdivision (Approved 6/9/86) - Minor revision to <br />drainage and utility easement along west boundary. <br />In attempting to file this plat with the County, Nancy <br />Husnick of the City Attorney's office, discovered that an <br />existing access easement in favor of Stan Shanedling, Kamm's <br />westerly neighbor, would take precedence over the proposed 10' <br />wide standard drainage and utility easement in the same location. <br />Shanedling would not sign a consent form waiving future damage <br />claims if the City at some point used this easement for utiltiy <br />or drainage purposes. In order to protect the City from future <br />claims, we have requested that Kamm revise the drainage easement <br />location to avoid Shanedling's easement. The lot boundaries <br />remain unchanged, and note that the standard boundary drainage <br />and utility easements do not reduce the calculated lot areas. <br />PROPOSED MOTION: Moved by _, Seconded by _, to approve the <br />revised drainage and utility easement location for the plat of <br />Lydiard Hills, applicant Ervin F.
