Kosak Residence <br />3265 Carman Road; Excelsior, MV 55331 <br />Dear Ms. Mabusth: <br />On behalf of Mr. Raymond Kosak, we are submitting the following request for <br />consideration by the Orono Planning Commission and Council. <br />A conditional use permit to replace an existing retaining wall that is <br />approximately 55 feet long and 3 feet high. The wall is in a deteriorated <br />condition and requires replacement to adequately retain the existing slopes <br />of the site. It is proposed the existing IO inch deep wall be replaced <br />with 6 inch deep treated Limbers and be , same length and height. This <br />will reduce the hardcover surface of this wall in the 0- lakeshore <br />setback zone by 40%. <br />2. A variance for hardcover within the 0-75- and 75-250' lakeshore setbsck <br />zones due to construction of a deck. The deck in question had been, until <br />recently, under construction without the necessary permits from the City. <br />The owner was not aware of the need for a building permit or hardcover <br />variance request. The deck is presently about 75% complete with another 92 <br />rough framed (see main and upper deck as shown on the attached certificate <br />of survey). <br />Existing impervious hardcover, prior to construction of the deck, was 2.61% <br />in the 0-75' zone and 37.38% in she 75-250' zone. Both represent a <br />variance to allowed hardcover. The calculations included roof, driveway, <br />walks, steps, retaining walls, etc. A porch has since been removed and an <br />area of concrete patio blocks is planned to be removed. <br />The deck is a multi -level structure, Interconnected with stairs and tied to <br />the various levels of the house. Since there is 17-20 feet of drop to the <br />lake from the house, the design intent of the deck was to create flat <br />activity areas adjacent to the house and pool without altering the existing <br />steep slopes and ground form.
