A RESOLUTION GRANTING <br />A VARIANCE TO <br />NUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #1050 <br />WHEREAS, Thomas R. Browne (hereinafter "the applicant") is the <br />owner of the property located at 760 South Brown Road within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />The South 396 feet of the West half of the Southwest quarter of the <br />Southeast quarter of Section 3, Township 117 North, Range 23 West of <br />the 5th principal meridian, Except the South 93 feet thereof <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.28, Subdivision 5 (B) to permit the <br />construction of a room addition and attached garage which will be located <br />37.2 feet from the front lot line where a 50 foot front lot line setback is <br />normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #10`-0. <br />2. The property is located in the RR-lB Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on July <br />21, 1986, and recommended approval of the proposed variance based upon <br />the following findings: <br />A) Proposed additions are no closer to front lot than the <br />previously existing screen porch. <br />B) Additions to this house in other directions t,.an those <br />proposed would be limited by the location of the wetland and by <br />the existing septic tank location. <br />C) Garage location is based on the new, safer driveway access <br />under construction and is limited by proximity to wetlands. <br />D) The additions are screened from the road by existing <br />shrubbery. <br />4. The City Council has considered this application including the <br />findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicant and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />Page 1 of 3 <br />
