�.. (� Ci.t� o� ORONO � � RESOLUTION OF THE CITY COUNCIL . � NO. 1451 • • � • • APPROVING PURCHASE AGREEMENT . AND SALE OF CITY LAND TO H. R. JOHNSTON WHEREAS, the City Council on September 28 , 1981, adopted Resolution #1323 "Approving The Sale Of A 1.2 Acre Parcel Of City Land To Harrison R. Johnston" , which land is legally described therein; and WHEREAS, Johnston has paid the City $500 in earnest money for said land; and WHEREAS, on February 8, 1982, the City Council agreed to amend the purchase agreement price of said land from $8,000 to $5,800 , and the Mayor and City Administrator thereafter executed an amended purchase agreement dated February 15, 1982; and WHEREAS, On September 27, 1982., the City Council agreed to further amend the purchase .agreement as follows: "If the Johnston's fail to get clear title of the 20 ' wide I":�• disputed corridor, the City will agree to repurchase the � .�„� parcel of said land for the same amount that he paid for � • it which was $5, 800, and to approve the most western lot as a buildable site without the 1. 2 acres of City land" ; and WHEREAS, on this date ,the City Council has reviewed a written amendment to the February 15, 1982, purchase agreement whi,ch amendment setsforth all the previous understandings of the Council regarding this matter; and WHEREAS, the City Council wishes to proceed with the sale of the subject land to Johnston, reaffirming Resolution #1323 ' s finding of no possible future public use for said land. NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono hereby approves the sale of a certain 1.2 acre parcel of City land to Harrison R. Johnston according to the terms and conditions ' setout in the Purchase Agreement dated February 15, 1982, as amended by the terms and conditions of the Amendment to Purchase Agreement dated January 24, 1983; and further that the City Council hereby authorizes the Mayor and City Clerk to sign the Amendment to Purchase � •
