Applicant plans to construct a deck to the ':st of the <br />proposed porch at some future time, and such porch could add as <br />much as 84 s.f. of hardcover to the property in the 75-250' <br />setback zone and still meet the 25% hardcover limit. <br />5. The City Council has considered this application including <br />the findings and recommendations of the P14nning Commission, <br />reports by City staf , comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />6. Tt e City Council finds that the conditions existing on this <br />property ar eculiar to it and do not apply generally to other <br />property this zoning district; that granting the variance <br />would not adversely affect traffic conditions, light, air nor <br />ose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the applicant, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />-nlicant; and would be in keeping with the spirit and intent of <br />the Zoning Cc.de and Comprehensive Plan of the City. <br />CONCLT'-IONS, ORDER AND CONDITIONS <br />Lased upon the above findings, the Orono City Council hereby <br />grants a variance to the Municipal Zoning Code Section 10.22, <br />Subdivision 1 to permit the corntruction of a screen porch encroaching <br />12' into the average lak ore setback zone, subject to the following <br />conditions: <br />1. The maximum allowable I over on this property in the 75- <br />250' setback zone is 3,886 s... or 25%. Existing 75-250' hard- <br />cover is 3,802 s.f. or 24.46%. Any future deck proposed to be <br />located adjacent to the proposed porch must not increase hard- <br />cover above 25% 1 im ` and any such deck must he constructed so <br />as to be considered ion -encroachment as defined in the Orono <br />Municipal Zoning Code. <br />2.
