that the Citing Zoning Ordinances have developed to <br />allow for three permitted uses and six conditional uses <br />in an RS District. <br />The conditional use brought into question by the <br />applicant is set forth in 510.31, Subd. 3C. Section <br />10.31, Subd. 3C, provides for a "day -use recreation <br />area" and the conditions under which such a permit may <br />be granted by the City. Subdivision 3C describes such <br />a recreational area as: <br />Land or structures owned or used by any private <br />club, association or group of unrelated <br />individuals as a regular meeting place for group <br />activities including without limitation boating <br />activities, swimming, fishing, picnicing, athletic <br />fields, nature trails and other day use. <br />The section goes on to illustrate the City's intention <br />of what is included under this description. <br />...This category includes day use scout, church, <br />Y:MC1. or YWCA camps, private non-profit park and <br />boating groups, clubs or associations <br />The applicant in this instance, Excelsior Bay Yacht <br />Club, is a for -profit club that offers its members a <br />three prong dues structure: $100.00 for a social <br />membership; $350.00 for a Commodore Club membership; <br />and $1,000.00 for corporate membership. The Commodore <br />Club is open to 300 charter members and its list of <br />privileges includes the "exclusive use of Dee-ing <br />Island recreation area". <br />The City Code sections pertaining to the purpose of a <br />RS District and the day -use recreation conditional use <br />do not specifically exclude commercial for -profit clubs <br />or associations from operating a day -use recreational <br />area within an RS District. Nevertheless, an argument <br />can be made that the City never intended that such a <br />use be permitted on the island. Specifically <br />supportive of such an argument is the fact that the <br />examples set forth in 510.30, Subd. 3C, of what groups <br />would fall within the category are limited to private, <br />nor, -profit groups such as scouts, churches, and the <br />YMCA/YWCA. Excelsior Bay Yacht Club, Incorporated does <br />not fall within this general category. The Council, <br />therefore, needs to determine whet::er or not it is in <br />the best interest of the community and consistent with <br />public policy to allow a commercial for -profit club to <br />utilize the island for the purposes outlined above. <br />-2- <br />
