A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 & 2 <br />AND SECTION 10.55, SUBDIVISION 8 <br />FILE #1033 <br />WHEREAS, Royal J. Dossett (hereinafter "the applicant") is <br />the owner of the property located at 2795 Pheasant Road within the <br />City of Orono (hereinafter "City") and legally described us follows: <br />Lot 11, Block 1, Pheasant Dawn, Hennepin County, Minnesota, <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has appliE, to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivision 1 and 2 <br />to permit t'le construction of a screen porch, drPck, and patio which <br />ronstitue structure in the 0-75 foot lakeshor�_- setback zone where no <br />.tructure is normally allowed, and increasing hardcover in the 0-75' <br />setback zone from 18 to 5.5% where no hard -,vei is normally allowed, <br />and increasing hardcover in the 75-250' setback zone from 26.4% t_-1 <br />27.2% where only 25% hardcover is normally allowed, and which .-ill <br />extend closer to the lake than the averac _ stance to the lake of the <br />adjacent properties. <br />NOW, THEREFORE, BE IT RESOIVED by the City CQu. cil of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1033. <br />The property is located in the I.R-lB Single Family Lakeshore <br />,sidential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />May 19, 1986, and recommended partial approval of the proposed <br />- ariances based upon the following findings! <br />A) The screen porch as proposed will not encrcic, y <br />views enjoyed '_)y the neighboring property owners. l-he <br />neighboring property owners have expressed their support for <br />the proposal. <br />R) The majority of the <br />drainage from the existing <br />house <br />away from <br />the lake <br />andonto the 75 -250' setback <br />zone. <br />applicant <br />maintains <br />a gutter system dire^ting <br />roof <br />drainage to the <br />75-250' setback zone, t.h:! only ru,.af f moving <br />directly toward <br />the lake <br />will be that generated n the <br />0-75' <br />setback zone. <br />Page 1 of 4 <br />
