. � <br /> � d <br /> C�t� o� ORONO <br /> � RESOLUTION OF THE CITY COUNCIL .. <br /> � NO. 1416 <br /> • <br /> • � • • <br /> A RESOLUTION APPROVING THE PLAT OF . <br /> WEST FOX . <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; and <br /> WHEREAS, the City Council of the City of Orono has adopted <br /> subdivision regulations �for •the orderly, economic and safe development <br /> of land within the City; and <br /> WHEREAS, the City Co,�uncil has considered the application for <br /> a subdivision plat by Merrill H. Gibbs, , the subdivider; and , <br /> WHEREAS, the City Council and the subdivider have entered <br /> • into a settlement agreement whereby the City relinquishes any claim <br /> to a public cartway over the east 16 .5 feet of Lot 36, Auditor 's <br /> . Subdivision No. 230 in exchange for an easement from the subdivider <br /> over the east 12 feet of Lot 36; and <br /> WHEREAS, the subdivider has completed all requirements of <br /> the platting regulations of the City, including: � <br /> 1. Completion of all the requirements of Resolution #1407 <br /> ' 2 . Dedication on the plat of right of way for a pubZic street <br /> shown as Count.y.:. Road No. 84 <br /> 3. Dedication on the plat of drainage and utility easements <br /> 4. Dedication to the City of a Flowage and Conservation <br /> Easement providing for limitations on the use of wetlands <br /> and/or drainageways described therein and shown on the <br /> plat as "drainage easements" <br /> 5. Creation of a 12 ' wide outlot shown on the plat as <br /> Outlot A, said outlot to remain in common ownership with <br /> Lot 2, Block l, West Fox <br /> 6 . Concurrent with the creation of Outlot A, the subdivider <br /> has granted a non-exclusive perpetual easement to the . <br /> City over and across Outlot A, West Fox, limiting the <br /> City' s use as follows: <br /> • <br />
